Bill to remove per-Country caps fails to clear senate
Bill that would have eliminated per-country caps on employment-based (EB) green cards and increased per country cap for family based green cards has failed to garner unanimous consent in the senate. The Bill failed after Senator David Perdue (R-GA) blocked the bill on Sept 19, 2019. The Bill had failed previously as Sen. Rand Paul (R-KY) had blocked the bill. The house bill H.R. 1044 was brought forth in the senate after it passed the house on July 10, 2019 by a sweeping majority of 365-65.
The senate bill S. 386, introduced jointly by senators Kamala Harris (D-CA) and Mike Lee (R-UT) if passes, will allow nationals of heavily backlogged country to apply for Green Card much earlier than they can now.
The bill if it passes would significantly benefit Indian nationals who often wait over a decade longer to apply for green card on Employment Based (EB) Categories compared to applicants from Rest of the world (applicants from countries other than China, India, El Salvador, Guatemala, Honduras, India, Mexico, Philippines, Vietnam).
Senator Lee expects to work with Georgia Senator who blocked the Bill on Sept 19, 2019 in order to push for a vote sometime next week.
