According to a recent notice from the USCIS, it has received sufficient electronic registrations to reach the H-1B cap (quota) for the Fiscal Year 2023. This cap includes both 65,000 regular H-1B visas plus an additional 20,000 visas available exclusively for advanced degree holders from US universities.

Like most years, USCIS used a lottery system to randomly select from among the registrations to reach the cap. The selection alone, however, is not sufficient. The selected registrants (i.e., petitioners who are usually US companies) and the named beneficiaries  must show their eligibility for H-1B based on existing requirements such as educational and professional credentials.

According to the USCIS notice, the selected registrants have been notified of their eligibility to apply for H-1B petitions and can begin filing the petitions for the named beneficiary/ies on April 1, 2022. The filing period is at least 90 days. To save time and avoid surprises later, it is recommended that the petitions be filed as soon as possible.

Though initial registrations could be done online, once selected, the H-1B petition itself must be filed on paper, and it must also include a hard copy of the notice of selection from USCIS among other required documents.

We hope that this article will help you to understand that employers should check their emails as the USCIS completed the H-1B Lottery for 2023.
